The author/webmaster (“Author”) is a certified health coach who has been trained to specialise in health, wellness, and lifestyle coaching.  She provides a non-medical, complimentary approach to the medical healthcare system.  You (sometimes referred to herein as “Client”) understand that the information received from us  (sometimes referred to herein as “Coach”) in connection with any of the Programmes or otherwise are for general health and educational purposes only and have not been evaluated by any government agency. Such information should not be seen as medical,  nursing or nutrition advice and is certainly not meant to take the place of your seeing licensed health professionals, including your doctor.

You understand and agree that (i) we are not providing health care, medical or nutrition therapy services and will not diagnose, treat or cure in any manner whatsoever, any disease, condition or  other physical or mental ailment of the human body, (ii) we are not acting in the capacity of a doctor, licensed dietitian or nutritionist, massage therapist, psychologist or other licensed or registered professional, and (iii) you have chosen to work with us and participate in the Programme voluntarily.

As your Coach, we encourage you to maintain a relationship with your doctor.  It is your responsibility to keep your doctor informed and get medical clearance before beginning or modifying any diet, supplements, exercise, or lifestyle programme. You should not modify or discontinue any prescription medications or course of medical treatment as a result of our programmes except as directed by your doctor.

You expressly assume the risks of the Author’s programs, relying upon the guides, and using the information provided by the Author. Under no circumstances shall the Author be liable for any direct, indirect, incidental, special or consequential damages arising from your reliance upon the  foregoing.

WHAT DATA DO WE COLLECT ABOUT YOU?

Personal data means any information capable of identifying an individual, it does not include anonymised data.

We may process certain types of personal data about you as follows:

Identity data – this may include your first name and last name, marital status, gender, title and date of birth.

Contact data – this may include your billing address, home address, email address and telephone number.

Transaction data- this may include details of payments between us and other purchases made by you.

Technical data – this may include your internet protocol address, browser type and version, plug-in types and versions, time zone setting and location, operating system and platform and other technology on the devices used to access this site.

Usage data – may include information about how you use our website, products and services.

Marketing data – this may include preferences in receiving marketing communications from us.

Sensitive data – we do not collect any sensitive data about you.  This relates to details about your race, ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, genetic or biometric data.  We also do not collect any information about criminal convictions and offences. The only sensitive data that may be collected is in terms of your overall health and wellbeing when working on personal coaching.  No medical records are collected.

Where we are required to collect personal data by law, or under the terms of the contract between us , and you do not provide us with that data when requested, we may not be able to perform the contract (for example to deliver goods or services to you).  If you don’t provide us with the requested data we may have to cancel a product or service you have ordered but if we do, we will notify you are the same time.

HOW WE COLLECT YOUR PERSONAL DATA

We collect data about you through a variety of different methods including:

  • Direct interactions – you may provide data by filling in forms on our site (or otherwise) or by communicating with us face to face, by post, phone, email or otherwise including when you order our products or services, subscribe to our service or publications, request resources or marketing be sent to you, enter a competition, promotion or survey, sign up to a webinar, give us feedback.
  • Automated technologies or interactions. As you use our site, we may automatically collect technical data about your equipment, browsing actions ans usage patterns.
  • Technical data from the following parties – when ordering our products or services, analytic providers such as Google based outside of the EU, advertising networks such as Facebook and Pinterest (inside or outside the EU), search information providers (inside or outside the EU), contact, financial and transaction data from providers of technical, payment and delivery services (based in or outside of the EU).

HOW WE USE YOUR PERSONAL DATA

We will only use your personal data when legally permitted.  The most common uses of personal data are:

  • where we need to perform a contract between us
  • where it is necessary for our legitimate interests and your interests and fundamental rights do not override those interests.
  • where we need to comply with a legal or regulatory obligation.

Generally we do not rely on consent as a legal ground for processing your personal data other than in relation to sending marketing communications to you via email.  You have the right to withdraw consent to marketing at any time by emailing vitalityhealthcoaching1@gmail.com or clicking unsubscribe at the bottom of any email

MARKETING COMMUNICATIONS

You will receive marketing communications from us if you have:

  • requested information from us or purchased good or services from us
  • if you provided us with your details when you registered for a competition or a promotion or free resources#
  • and in each case you have not opted out of receiving that marketing.

Where you opt out of receiving our marketing communications, this will not apply to personal data provided to us as a result of a product/ service purchase or experience or other transactions.

DATA RETENTION

We will only retain your personal data for as long as is necessary to fulfil the purposes we collected it for, including the purposes of satisfying any legal, accounting or reporting requirements.

By law we have to keep basic information about our customers (including contact, identity, financial and transaction data) for six years after they cease being customers, for tax purposes.

In some circumstances you can ask us to delete your data except for where your data is anonymised for research or statistical purposes.

YOUR LEGAL RIGHTS

Under certain circumstances, you have rights under data protection laws in relation to your personal data.  These include the right to:

  • request access to your personal data
  • request correction of your personal data
  • request erasure of your personal data
  • object to processing of your personal data

You will not have to pay a fee to access your personal data however we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.  Alternatively we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and enusre your right to access your personal data.  This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.

We try to respond to all legitimate requests within one month. Occasionally it may take us monger than a month if your request is particularly complex or you have made a number of requests.
